Mr. Aita has extensive experience in Civil Rights matters. He served as one of the lead counsel In Re: Camden Police Cases whereby approximately 80 individuals brought suit for damages for violation of civil rights due to police misconduct. Five Camden Police Officers arrested innocent individuals and planted evidence, stole money, and lied under oath to cover up for the illegal conduct. The matter was ultimately settled for $3,000.000.
The United States Constitution 42 U.S.C. sec. 1983 allows a person to recover money damages for a violation of civil rights. If you are successful in your claim, the law allows for payment of your legal fees by the responsible party.
In addition to a possible violation of constitutional law, New Jersey law permits someone who is wrongfully convicted and incarcerated to collect damages from the State of New Jersey under the Wrongful Incarceration Act, N.J.S.A.
