Aggressive representation does not end when the court case is over. Every individual who has served their time deserves a fresh start. We continue to help individuals convicted of a crime with the process of expungement once they have completed their sentence.
All Accused Individuals Have Rights
Every individual charged with a crime has certain constitutional rights that must be protected throughout the criminal process. The courts, police, and prosecutors must afford rights for all those accused of criminal actions under the Fourth Amendment, which prohibits illegal searches and seizures; the Fifth Amendment, the right for the defendant to remain silent and not be forced to testify against themselves; the Sixth Amendment, the right to have a lawyer and a speedy trial by jury; and the Eight Amendment, the right to reasonable bail and the prohibition of cruel and unusual punishment.
Potential Criminal Charges
Under New Jersey law, individuals can be charged with a wide range of criminal offenses categorized as traffic violations, local ordinance violations, disorderly persons offense, and first, second, third, or fourth-degree crimes. Individuals charged with first or second-degree crimes typically face jail time if convicted. First degree crimes, such as murder, aggravated manslaughter, and armed robbery, could result in a prison sentence from 10 years to life without parole in a New Jersey state prison. Individuals convicted of a second-degree crime, such as sexual assault, manufacturing or distribution of certain controlled substances, or theft in excess of $75,000, may face up to 10 years in a New Jersey state prison.
Individuals with no prior convictions charged with third or fourth-degree crimes, such as weapons offenses, certain drug offenses, or possession of marijuana generally face little to no jail time with monetary fines and probation. Charges of disorderly conduct offenses typically are handled by the municipal court with smaller fines and less than a year of jail time. Common disorderly conduct offenses include simple assault, harassment, shoplifting, and possession of marijuana for personal use.
